What is the Berry Amendment?

Originally passed by Congress in 1941, the Berry Amendment promotes the purchase of certain U.S. goods. The Amendment was included in every subsequent defense appropriations act until it was made permanent in 1994 and subsequently codified as USC, Title 10, Section 2533a by section 832 of Public Law 107-107.

In essence, the Berry Amendment requires the Department of Defense (DOD) to give preference in procurement to domestically-produced or domestically-manufactured products—in our case, fabrics and, to a lesser extent, specialty metals.

The Amendment was named for South Dakota Representative Ellis Yarnall Berry, who, during his first term in congress in 1951 introduced an amendment to the Buy American Act to expand the law to include all clothing, cotton, and wool. In the years since, exceptions and exemptions have been granted for select commercial-off-the-shelf (COTS) items, small amounts of non-domestic metals, and certain other materials and products.

Berry Compliant Manufacturing

The most current interpretation of the Berry Amendment applies generally to textile materials and products made from those textiles. In order to be deemed Berry Amendment-compliant, manufacturers such as the Airtex Group must source all materials from and perform all manufacturing/production processes in the United States.
